TOS

This is my Terms of Service for the buying and usage of my products and services acquired through commissioning me. Consent to and following these terms are required before requesting any services from me. These terms have been written to ensure the security and safety of me and my rights as an artist online.

Blatant or malicious misuse or mistreatment of my services or products, in correspondence with this TOS, is grounds for legal action from me against the offending party.

I, Rookoorwill (to be referred to thusly as I, me, my, etc.), have written these Terms of Service as a guideline by which a commissioner (to be referred to thusly as commissioner, employer, client, they, you, etc.) must agree to and follow when requesting, receiving, and using my products and services. By initiating a business relationship with me, you are agreeing to these terms in full, and are thus agreeing to the legally binding nature of these terms.

❗️I reserve the right to add to or change my TOS at anytime. All clients of mine will be kept up to date with any changes I make to my TOS, and must agree to them before any further work or transactions can take place.❗️

MY RIGHTS:
– I reserve the right to refuse to work on anything, or with anyone, for any reason without explanation for said refusal. I reserve to right to choose not to do business with any person or corporation on my own discretion.
•This term is applicable to anyone in the process of requesting my services, and before any compensations have been exchanged.

– I reserve the right to quit work on any production or business-related venture should I find probable cause that I am being illegally, immorally, or financially taken advantage of under USA labor laws.

– I reserve the right to issue a leave request of a minimum of two weeks and a maximum of however is allowed by my employer should a major life event, hardware issue, or other unavoidable issue prevent me from working.

– I reserve the right to refuse to refund money back to my employer should I either be over 2/3 of the way finished with their commission, and/or have had said commission in my work list for less than 2 months after the estimated time of completion rate has passed. Should either or both be unapplicable, I will finish the commission with the payment I have received. Should both be applicable, the commissioner will receive a full refund*.
• *For animation related rates, should my employer rightfully request a refund on their commission, I reserve the right to partially refund said commissioner for any part of the animation I had not yet 100% completed. The commissioner will still receive what had been 100% finished and may use it however originally agreed upon.

– I reserve the right to take legal action against anyone using my art for unsavory or unagreed upon usage. These usages include but are not limited to: use as NFTs, added to any AI art generators, used as a visual to present hate speech or bigoted views, used as a basis for NSFW or illegal NSFW art or behavior, etc.

– I reserve the right to add any of my completed work to my art portfolio for archival purposes. Credit to the commissioner, caricatures or characters, or part of the commission that is otherwise not solely my own will be given.
• My portfolio is not monetized.

– I reserve the right to document the transaction process for archival, liability, legal, and proof of monetary exchange purposes.
• This documentation is classified and may only ever be viewed or kept by myself, the commissioner of said transaction, and legal team of either or both parties (that being of myself and the commissioner).

COMMISSIONER RIGHTS:

– The commissioner may not under any circumstances claim that my work has been created by anyone other than myself, regardless of monetary or intellectual ownership.

– The commissioner may use my work in any outlet that has been agreed upon on purchase. Further use of received material outside of initial agreement must be given my full permission before further usage has been made, and additional compensation and rates may apply.
• All public use of my works must be credited to me where and when applicable.

– The commissioner may contact me at any time and as often as they like regarding the status, progress, or otherwise in any way related to their commission.
